The role of unifying personal status laws in achieving Islamic unity

The title is an article by Nagham Ishak Zaya and Nadia Khairaldeen Aziz about the unity of the Islamic Ummah, opposing nationalism, published in Journal “الرافدین للحقوق”, Vol. 12, no. 34, pp. 85 – 139 by University of Mosul College of Law.[1]


Introduction

Praise be to God who made the unit of submission to the Islamic law sources and the provisions contained in it. The Islamic law sources can be considered the basis and effective factor to achieve the unity of this nation in every relevant area.

Islamic family in Islamic laws

However, the most important point is related to one of the most important entities of this nation based on the Islamic family and the life of its provisions regulated by this law in its legal form represented by the laws of personal status. The personal status laws is based on the jurisprudence of this law and its various missions and what we chose to be content and purpose title of our research. In the research, we seek to be a way to achieve the unity of Muslims, we have great hope, God willing, as we are based on a factor.

Unity of submission to Islamic law

However, the unity of submission to Islamic law among the Islamic countries in the framework of personal status laws and the belief that the issue of unification of personal status laws can play a prominent role in the achievement of Islamic unity and not across the Arab region. But Islamic and that we chose to give most of the legislation of this region the model on it as part of this nation to get from it to the largest unity, but the unity of the Islamic nation in this regard, especially as it adopts the sources of laws related to personal status can not go out in it.

This is on the one hand, with the availability of signs to help achieve this unity, which is the trend towards non-adherence to a particular doctrine. but the quotation from the rest of the other sects to serve the interests of the Muslim family and to take into account as much as possible the traditions of this nation and the unity of its people in submission to Islamic law.

Conclusion We have learned from the texts of this legislation as well as the unity projects that have been put forward in the Arab region in this field. On the other hand, the basic factor for choosing the research on this subject is the role of unifying personal status laws in achieving Islamic unity.
